Tukang App — Terms & Conditions (Worker)

Important: These Terms govern your use of the Tukang Worker App. By accepting, you agree to provide services as an independent contractor. If there is any inconsistency between languages, the English version prevails.

1. Introduction

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Worker", "you") and PT FIXID INTERNATIONAL DEVELOPMENT ("Company", "we", "us", "our") governing your access to and use of the Tukang Worker mobile application and related services (the "App").

By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the App.

2. Definitions

  • "Worker" means an independent third-party service provider offering services through the Tukang platform.
  • "Service" means on-demand labor/handyman services requested by Users through the App.
  • "Booking" means a confirmed service request made by a User and accepted by a Worker.
  • "Platform Fee" means the service fee charged by the Company for use of the App (currently 10% of the service price).
  • "User" means a customer requesting services through the Tukang platform.
  • "Content" includes profile information, photos, reviews, messages, and any other material uploaded to the App.

3. Independent Contractor Status

You are an independent contractor, not an employee. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and the Company.

  • You have sole discretion over when, where, and how to provide Services (subject to these Terms).
  • You are free to use other platforms or provide services independently.
  • You are responsible for all taxes, insurance, and benefits associated with your work.
  • The Company does not withhold taxes, provide workers' compensation, or offer employee benefits.
  • You must comply with all applicable laws, including licensing and permit requirements.

4. Eligibility

To use the App as a Worker, you must:

  • Be at least 18 (eighteen) years old
  • Be legally eligible to work in Indonesia
  • Possess valid identification (KTP/Paspor)
  • Have the necessary skills, tools, and insurance for the Services you offer
  • Pass any background checks or verification processes required by the Company

5. Worker Account

To use the App, you must create an account and provide accurate, complete information including:

  • Full name (as shown on ID)
  • Phone number (OTP verification)
  • Email address
  • Valid government ID (KTP/Passport)
  • Profile photo
  • Skills and services offered
  • Bank account details for payments

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must promptly notify the Company if you suspect unauthorized access.

6. Verification & Background Checks

The Company may perform identity verification and background checks. By accepting these Terms, you consent to such checks. The Company reserves the right to reject or terminate any Worker based on verification results.

7. Services & Conduct

As a Worker, you agree to:

  • Provide Services with reasonable skill and care
  • Arrive on time for confirmed Bookings
  • Communicate professionally with Users
  • Wear appropriate attire and maintain hygiene
  • Carry necessary tools and equipment
  • Complete Services as agreed with the User
  • Comply with all applicable laws and regulations

Prohibited Conduct: You must not:

  • Harass, abuse, threaten, or discriminate against Users
  • Provide false or misleading information
  • Solicit off-app payments to avoid Platform Fees
  • Perform illegal, unsafe, or prohibited services
  • Manipulate ratings or reviews
  • Share confidential User information
  • Use drugs or alcohol before or during Services

8. Bookings & Pricing

  • The Company establishes standard pricing benchmarks based on service type and location.
  • The final price must be mutually agreed by the User and Worker before a Booking is confirmed.
  • Workers may set prices within the App's guidelines but may not exceed the maximum allowed markup (30% above benchmark).
  • You may accept or decline any Booking request. Acceptance rates may affect your visibility.
  • Cancellation policies apply. Excessive cancellations may result in account suspension.

9. Platform Fees & Payments

Platform Fee: The Company charges a 10% Platform Fee on each completed Booking (unless otherwise stated). This fee is deducted before payment is released to you.

Payment Methods:

  • Cash: Users may pay you directly in cash. You must confirm receipt in the App.
  • In-App Card Payments: Payments are processed via secure third-party processors (Xendit). Funds are held in escrow and released after User confirmation.

Payment Schedule: For in-app payments, funds are transferred to your registered bank account within 1-3 business days after release. Minimum payout thresholds may apply.

Disputes: If a User disputes a payment, the Company may temporarily hold funds during investigation. You agree to cooperate in resolving disputes.

10. Cancellations & No-Shows

  • If you need to cancel a Booking, do so as early as possible through the App.
  • Excessive cancellations or no-shows may result in account suspension or termination.
  • Users may cancel Bookings with applicable fees as shown in the App.
  • If a User does not show up or cancels after you've arrived, you may be eligible for a cancellation fee.

11. Ratings & Reviews

  • Users will rate you after each completed Service (1-5 stars).
  • Written reviews may be submitted and are visible on your profile.
  • Ratings affect your visibility, ranking, and access to Bookings.
  • The Company may remove reviews that are fraudulent, abusive, or violate platform rules.
  • You may not manipulate ratings or solicit fake reviews.

12. Insurance & Liability

You are responsible for obtaining adequate insurance coverage, including:

  • Public liability insurance (for damage to property)
  • Professional indemnity insurance
  • Personal accident/health insurance
  • Tool and equipment insurance

The Company does not provide insurance for Services performed through the platform. You assume all risks associated with providing Services.

Liability: You are solely responsible for any damage, injury, or loss caused during Services. You agree to indemnify and hold the Company harmless from any claims arising from your actions.

13. Safety & Compliance

  • You must follow all safety protocols and use appropriate personal protective equipment (PPE).
  • Report any unsafe conditions to Users and the Company.
  • Do not perform services beyond your skill level or without proper licensing.
  • In case of emergency, contact local authorities first, then notify the Company.

14. Intellectual Property

All intellectual property rights in the App (trademarks, logos, software, content) are owned by or licensed to the Company. You may not copy, modify, distribute, or reverse engineer any part of the App.

By uploading content (photos, profile information), you grant the Company a license to use, display, and distribute that content for platform operations and marketing.

15. Account Suspension & Termination

The Company may suspend or terminate your account (with or without notice) if:

  • You violate these Terms or applicable laws
  • Fraudulent, suspicious, or abusive activity is detected
  • You have excessive cancellations or poor ratings
  • You fail verification or background checks
  • Required by legal or regulatory obligations
  • To protect the rights, safety, or integrity of the platform

You may terminate your account at any time via App settings or by contacting support. Upon termination, you will receive any outstanding payments for completed Bookings.

16. Data Protection & Privacy

Your personal data is processed in accordance with our Privacy Policy, which is incorporated into these Terms. You consent to:

  • Collection and use of your personal information
  • Sharing necessary information with Users (name, photo, ratings)
  • Location tracking during active Bookings
  • Background checks and verification

17. Limitation of Liability

To the maximum extent permitted by law:

  • The Company is not liable for any indirect, incidental, or consequential damages
  • The Company's total liability is limited to the Platform Fees paid to you in the 3 months preceding a claim
  • The Company does not guarantee the number or value of Bookings

This limitation does not apply to liability for death, personal injury, fraud, or matters that cannot be excluded by law.

18. Indemnification

You agree to indemnify and hold the Company harmless from any claims, damages, losses, and expenses (including legal fees) arising from:

  • Your provision of Services
  • Your violation of these Terms
  • Your violation of applicable laws
  • Your interactions with Users
  • Any injury, damage, or loss caused by your actions

19. Force Majeure

The Company is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, internet outages, power failures, governmental actions, or third-party service failures.

20. Changes to Terms

The Company may update these Terms from time to time. Material changes will be notified via email or in-app notification. Continued use after changes become effective constitutes acceptance of the updated Terms.

21. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Indonesia. Any disputes shall first be attempted to be resolved through good faith negotiations. If unresolved, disputes shall be resolved in the competent courts of Denpasar, Bali.

Informal Dispute Resolution: Before filing any claim, you agree to contact the Company at legal@fixid.com to attempt informal resolution for 30 days.

22. General Provisions

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver: Failure to enforce any right does not constitute a waiver.

Entire Agreement: These Terms constitute the entire agreement between you and the Company.

Assignment: You may not assign these Terms without written consent. The Company may assign these Terms in connection with a merger, acquisition, or sale.
